Balance of powers

Constitutions are founding documents. They establish corporate bodies. 

Constitutions primarily restrain the parties and delimit the exercise of their power. Constitutions set out the way in which distinct powers balance each other out. 

As such, the balance of powers written into the American Constitution is intrinsically covenantal.
